Nonprofit worker weeps as he recounts 'stop and frisk' incident

NEW YORK (AP) ? A 24-year-old nonprofit worker wept on the witness stand Tuesday as he described an unnerving episode of being handcuffed near his home while an officer took his keys and went inside his building.

Nicholas Pert, who is black, is one of about a dozen New Yorkers expected to tell their stories of being stopped, questioned and frisked by police in a federal trial challenging how police use the tactic. About 5 million stops have been made during the past decade, mostly of black and Hispanic men.

The lawsuit challenges the constitutionality of some of the stops, with lawyers arguing the policy unfairly targets minorities.

City attorneys said officers operate within the law and do not target people solely because of their race. Police go where the crime is ? and crime is overwhelmingly in minority neighborhoods, city lawyers said.

Pert's mother died of cancer, and he is the guardian for his three siblings, two small boys and his disabled 20-year-old sister. The stocky community college graduate testified that he was stopped four times, starting on his 18th birthday.

But it was a stop in 2011 that reduced him to tears.

He testified that he was walking to the corner store at about 11 p.m. to get milk when officers stopped him, handcuffed him and put him in the back of a squad car. One officer took Pert's keys, he said, and went into his building. Pert said he was concerned because he didn't know how his siblings would react if the officer knocked on the door.

"I was afraid he would go into my apartment, and I wasn't there to take care of the situation," he said.

Eventually the officer returned and he was freed.

Pert said, pausing to collect himself, that he felt criminalized by the episode.

"To be treated like that, by someone who works for New York City, I felt degraded and helpless," he said.

City lawyers sought to discredit witnesses by suggesting their stories had evolved to become more dramatic and their memories were faulty.

Pert testified that he filed one complaint against the police where he lied and said he had been physically injured. He also said one of the stops happened in May 2011, instead of April 2011, had trouble recalling the race and descriptions of officers who stopped him, sometimes contradicting himself, and published angry Facebook posts insulting the police department.

Lawyers for the Center for Constitutional Rights, which filed the class-action suit, are trying to show a pattern of racist and inappropriate behavior by the police.

Stop and frisk is legal, but the lawyers who sued say it must be reformed. They are asking for a court-appointed monitor to oversee any changes ordered by the judge.

About half the people who are stopped are subject only to questioning. Others have their bag or backpack searched. And sometimes police conduct a full pat-down. Only about 10 percent of all stops result in arrest, and a weapon is recovered a small fraction of the time.

A police whistleblower, Adhyl Polanco, testified that his superiors only cared about arrests, summonses and stops. He said they told him he needed 20 summonses, five street stops and one arrest per month ? or he'd face poor evaluations, shift changes and no overtime.

"They can make your life very miserable," he said.

Polanco was suspended with pay for years after internal affairs officers brought charges of filing false arrest paperwork; he says the charges came because he detailed a list of complaints to internal affairs.

The mayor and police commissioner say stop and frisk is a life-saving, crime-stopping tool that has helped drive crime down to record lows. Officers have more than 23 million contacts with the public, make 4 million radio runs and issue more than 500,000 summonses every year. Comparatively, 600,000 stops annually are not unreasonable, city lawyers said.

U.S. District Court Judge Shira Scheindlin, who has already said in earlier rulings that she is deeply concerned about the tactic, has the power to order reforms to how it is used, which could bring major changes to the nation's largest police force and other departments.

City lawyers said the department already has many checks and balances, including an independent watchdog group that was recently given authority to prosecute some excessive force complaints against police. The police commissioner still has the final say on whether officers are disciplined.

In Albany on Tuesday, state Assembly Speaker Sheldon Silver said restrictions on stop-and-frisk were among the few remaining issues in closed-door negotiations over the state budget.

Goodell: No expanded playoffs for 2013

(AP) ? The Ravens certainly will get to celebrate their Super Bowl triumph again in their home stadium, maybe even while honoring the retired Ray Lewis.

It just might not happen to open the next NFL season.

Downtown Baltimore already will be a busy place on Sept. 5, when the league planned to hold its traditional Thursday kickoff game hosted by the champions.

The Orioles have a night game at Camden Yards, which shares parking lots with the Ravens' home stadium.

Unless the Ravens and the NFL can get the Orioles to run a reverse and move the game to the afternoon or to another day ? without violating any Major League Baseball rules ? Joe Flacco and company could open on the road.

So far, there's been no progress, and Sept. 4 is not an option because it's the first night of Rosh Hashanah.

NFL Commissioner Roger Goodell twice has spoken with his MLB counterpart, Bud Selig, seeking a solution.

"Unfortunately, the only (other) option is to take the Ravens on the road," Goodell said. "We think that is wrong for the Ravens' fans. We would not want that to happen.

"We are working on parallel tracks for a couple more weeks. Clearly, we are getting to a point where we have to make that decision."

The Orioles are scheduled to play the Indians in Cleveland on Sept. 4 at 7:05 p.m. and then open a series at home against the White Sox on Sept. 5 at 7:05 p.m.

Under baseball's collective bargaining agreement, getaway games shall not be scheduled or rescheduled to start later than 5 p.m. if either club is required to travel for a day game, scheduled the next day, between cities in which the in-flight time is more than 1? hours.

The rule can be waived by a vote by the players on the team it affects, in this case the Orioles.

Last year, the NFL moved the opener to a Wednesday night to avoid conflicting with President Barack Obama's acceptance speech at the Democratic Convention.

"We have had discussions with representatives of the Orioles, and we have offered to make them financially whole," Ravens President Dick Cass posted Monday on the team's Twitter account. "We've left it there. Now the commissioner is trying to find if he can find a solution."

Goodell also said the playoffs will not expand this season, but it will be discussed for the future. Last December, Goodell spoke about adding two or four teams to the current 12-team format.

"The competition committee looked at some of the issues," said Goodell, who added the league needs to discuss expanded playoffs with the players' union, too.

"Now, we have a little bit of work to do before we can advance it. It clearly won't be happening for this year if there was any doubt about that."

Surrounded by six Pro Football Hall of Famers at a news conference, Goodell and Jim Brown announced that the league will pay $42 million as part of a settlement with a group of retired players who sued over the use of their names and images without their consent.

"We have a common good fund in our agreement that will allow us to reach out and help a lot of our players who really need help," Brown said, "and not only that, but to help their spouses who some are suffering. We have individuals who are homeless.

"Today is like a coming back together because we can publicly say that we are doing something together that is going to be a landmark happening for people who truly need it."

Carolina Panthers owner Jerry Richardson, a former NFL receiver, said the agreement was "better late than never."

"Some of my most frustrating moments in discussions have evolved around this issue of what in my judgment is fairness to the former players of the league who were not included in the benefit packages and (not) appreciated the way they should," Richardson said. "It is a new day. I am honored that this day has arrived. I am very grateful it is here."

Moments later, Goodell came down hard on teams that consider asking questions about a player's sexual orientation at the scouting combine.

Michigan quarterback-turned-receiver Denard Robinson, Colorado tight end Nick Kasa and Michigan State running back Le'Veon Bell indicated they were asked about it last month in Indianapolis.

"We have been following up with the players and their representatives directly," Goodell said. "We are also this afternoon working with all of our executives that lead in that position to make sure they understand what you can't ask and what you can ask. We're a professional organization. That's unacceptable. We will do things the right way. We will give them that education and that training. I hope that that will solve the problem."

Goodell also dismissed the notion that problems caused by the third-quarter blackout during the Super Bowl will damage New Orleans' chances of hosting the game again. The league believes New Orleans authorities discovered the source of the problem that caused a 32-minute delay.

"They did a great job," Goodell said. "I mentioned that this morning to our membership and I think they deserve another Super Bowl."

Goodell also:

?Said there will be no change to the $36 million salary cap reduction the Washington Redskins were hit with in 2012; $18 million last year and $18 this year. Redskins general manager Bruce Allen recently called the penalty "a travesty of fairness."

?Admitted there was improved effort in the players' performance at the Pro Bowl and there will be further discussions here on its future.

?Reiterated the league's desire to place a franchise in Los Angeles. He even thought Philip Anschutz's decision not to sell AEG, which has interest in building a stadium downtown, is "very positive."

"We want to get back to Los Angeles, but we are going to look at every alternative we have to do that successfully," he said.

?The NFL also approved terms and conditions for the new lease and renovation of the Buffalo Bills' stadium.

"This is another important step in the process toward finalizing the related definitive agreements and remaining on schedule to begin the improvements this year," Bills CEO Russ Brandon said.

?Said the league is expanding a relationship with Mothers Against Drunk Driving.

New study validates longevity pathway

A new study demonstrates what researchers consider conclusive evidence that the red wine compound resveratrol directly activates a protein that promotes health and longevity in animal models. What's more, the researchers have uncovered the molecular mechanism for this interaction, and show that a class of more potent drugs currently in clinical trials act in a similar fashion. Pharmaceutical compounds similar to resveratrol may potentially treat and prevent diseases related to aging in people, the authors contend.

These findings are published in the March 8 issue of Science.

For the last decade, the science of aging has increasingly focused on sirtuins, a group of genes that are believed to protect many organisms, including mammals, against diseases of aging. Mounting evidence has demonstrated that resveratrol, a compound found in the skin of grapes as well as in peanuts and berries, increases the activity of a specific sirtuin,SIRT1, that protects the body from diseases by revving up the mitochondria, a kind of cellular battery that slowly runs down as we age. By recharging the batteries, SIRT1 can have profound effects on health.

Mice on resveratrol have twice the endurance and are relatively immune from effects of obesity and aging. In experiments with yeast, nematodes, bees, flies and mice, lifespan has been extended.

"In the history of pharmaceuticals, there has never been a drug that binds to a protein to make it run faster in the way that resveratrol activates SIRT1," said David Sinclair, Harvard Medical School professor of genetics and senior author on the paper. "Almost all drugs either slow or block them."

In 2006, Sinclair's group published a study showing that resveratrol could extend the lifespan of mice, and the company Sirtris Pharmaceuticals, which was started by HMS researchers, was founded to make drugs more potent than resveratrol. (Sinclair is a co-founder of Sirtris, a GlaxoSmithKline company, and remains a scientific advisor. Sirtris currently has a number of sirtuin-activating compounds in clinical trials.)

But while numerous studies, from Sinclair's lab and elsewhere, underscored a direct causal link between resveratrol and SIRT1, some scientists claimed the studies were flawed.

The contention lay in the way SIRT1 was studied in vitro, using a specific chemical group attached to the targets of SIRT1 that fluoresces more brightly as SIRT1 activity increases. This chemical group, however, is synthetic and does not exist in cells or in nature, and without it the experiments did not work. As a response to this, a paper published in 2010 surmised that resveratrol's activation of SIRT1 was an experimental artifact, one that existed in the lab, but not in an actual animal. SIRT1 activity in mice was, the paper claimed, at best an indirect result of resveratrol, and perhaps even a sheer coincidence.

As a result, a debate erupted over the particular pathway that resveratrol and similar compounds affected. Does resveratrol directly activate SIRT1 or is the effect indirect? "We had six years of work telling us that this was most definitely not an artifact," said Sinclair. "Still, we needed to figure out precisely how resveratrol works. The answer was extremely elegant."

Sinclair and Basil Hubbard, then a doctoral student in the lab, teamed up with a group of researchers from both the National Institutes of Health and Sirtris Pharmaceuticals to address this question.

First, the team addressed the problem of the fluorescent chemical group. Why was it required for resveratrol to rev up SIRT1 in the test tube? Instead of dismissing the result as an artifact, the researchers surmised that the chemical might be mimicking molecules found naturally in the cell. These turned out to be a specific class of amino acid, the building blocks of proteins. In nature, there are three amino acids that resemble the fluorescent chemical group, one of which is tryptophan, a molecule abundant in turkey and notable for inducing drowsiness. When researchers repeated the experiment, swapping the fluorescing chemical group on the substrate with a tryptophan residue, resveratrol and similar molecules were once again able to activate SIRT1.

"We discovered a signature for activation that is in fact found in the cell and doesn't require these other synthetic groups," said Hubbard, first author of the study. "This was a critical result, which allowed us to bridge the gap between our biochemical and physiological findings.

"Next, we needed to identify precisely how resveratrol presses on SIRT1's accelerator," said Sinclair. The team tested approximately 2,000 mutants of the SIRT1 gene, eventually identifying one mutant that completely blocked resveratrol's effect. The particular mutation resulted in the substitution of a single amino acid residue, out of the 747 that make up SIRT1. The researchers also tested hundreds of other molecules from the Sirtris library, many of which are far more powerful than resveratrol, against this mutant SIRT1. All failed to activate it.

The authors propose a model for how resveratrol works: When the molecule binds, a hinge flips, and SIRT1 becomes hyperactive.

Although these experiments occurred in a test tube, once the researchers identified the precise location of the accelerator pedal on SIRT1?and how to break it?they could test their ideas in a cell. They replaced the normal SIRT1 gene in muscle and skin cells with the accelerator-dead mutant. Now they could test precisely whether resveratrol and the drugs in development work by tweaking SIRT1 (in which case they would not work) or one of the thousands of other proteins in a cell (in which they would work). While resveratrol and the drugs tested revved up mitochondria in normal cells (an effect caused activating by SIRT1), the mutant cells were completely immune.

"This was the killer experiment," said Sinclair. "There is no rational alternative explanation other than resveratrol directly activates SIRT1 in cells. Now that we know the exact location on SIRT1 where and how resveratrol works, we can engineer even better molecules that more precisely and effectively trigger the effects of resveratrol."

CARACAS, Venezuela ? Hugo Chavez something did something a bit strange last summer.?

He secretly sent a team of forensic scientists to open the coffin of independence hero Simon Bolivar and exhume his remains.

The Venezuelan president wanted to investigate exactly how Bolivar, who was instrumental in driving the Spanish out of Latin America, died almost two centuries ago.


While most historians say tuberculosis killed Bolivar when he was 47, Chavez had another theory. He suspected that Bolivar was poisoned.

Tens of thousands of grieving Venezuelans lined up for miles in the streets of Caracas to pay their respects to the open coffin of Hugo Chavez.  ITV's Matt Frei reports. 

At the time, Chavez was campaigning to win another term as president of Venezuela.

Just weeks earlier, the Venezuelan president had declared himself "free, free, totally free," of the cancer that killed him on Tuesday. It was the second time Chavez would claim he was cured.

Throughout his 14-year rule, Chavez often evoked Bolivar's image, claiming his socialist state was just the next stage in Bolivar's campaign to liberate the continent from outside domination.

Chavez made a big show of the investigation on national TV, even showing footage of Bolivar's skeleton while playing the national anthem. "Viva Bolivar," said Chavez. "The great Bolivar has returned!"

Chavez then decided to build a $150 million grandiose monument at the National Pantheon in Caracas to house Bolivar's remains. At the time, Chavez said the aim was to "glorify Bolivar."

Perhaps he had his own final resting place in mind as well.

Under Venezuelan law, only national heroes are bestowed the honor of repose at the National Pantheon, and any candidate must have died at least 25 years earlier.

Already, a national campaign has begun in Venezuela to lay Chavez's remains alongside his beloved Bolivar. There are even loud whispers of initiating a national referendum to vote on changing the Constitution to amend the 25-year rule.

Some of Chavez's supporters allege another thing may unite the two men.

Venezuelan Vice President Nicolas Maduro promised the government would launch a "scientific investigation" into suspicions that Chavez was poisoned. Who would be responsible? Maduro blamed "the country's historical enemies."

Time will tell if the investigation into Chavez's illness reveals anything nefarious behind the cancer that killed him. They couldn't prove much testing Bolivar's remains.

"We could not establish death was by non-natural means or by intentional poisoning," the Chavez government admitted.

For Chavez, that didn't matter. To the day he died, he continued to believe there had been a "great farce" and "cover-up" of Bolivar's death.?

"They killed Simon Bol?var. They murdered him and, even though I don't have proof, the circumstances in which he died point to that," he concluded.

Chavez's supporters are now on the hunt for their own smoking gun.

Clashes at iconic Al-Aqsa mosque raise tensions

TEL AVIV, Israel - Dozens of Israeli security officers and Palestinian worshipers clashed at the Al-Aqsa mosque in Jerusalem on Friday, amid rising tensions ahead of a visit by President Barack Obama.?

According to Israeli police spokesman Micky Rosenfeld, police entered Al-Aqsa after Palestinians threw stones and two firebombs at them. ?The situation was under control, although there were still several masked men in the mosque, which the police would not enter, he said.

Al-Aqsa is one of Islam's holiest sites. It is also revered by Jews as the site of their Biblical temple.

Some have blamed a 2000 visit to the area by then-Likud leader Ariel Sharon and Israeli security forces for helping to spark the Palestinians' Second Uprising -- or Intifada.?

The latest clashes erupted in the wake of unconfirmed reports that an Israeli security guard? entered Al-Aqsa, beat a child and kicked the Muslim holy book, the Quran.

Two days ago, right-wing politician Moshe Feiglin stopped at the compound?s doorway, further raising tensions. ?

A recent surge in violence in the occupied West Bank has fed worries that a new Palestinian uprising was developing. Obama is due to visit Jerusalem and Ramallah in the West Bank at the end of the month.?

Too much salt may trigger autoimmune diseases: studies

CHICAGO (Reuters) - Increased salt consumption may be a key culprit behind rising rates of autoimmune diseases such as multiple sclerosis, researchers reported on Wednesday in a trio of papers looking at the role of a specific class of cells linked with inflammation.

Reporting in the journal Nature, the researchers said high-salt diets increased levels of a type of immune cell linked with autoimmune disease. And mice genetically engineered to develop multiple sclerosis (MS) got much worse when they ate what amounted to a high-salt Western diet compared with mice who had more moderate salt intake.

The findings suggest that salt may play a previously unknown role in triggering autoimmune diseases such as MS or type 1 diabetes in individuals who are already genetically predisposed.

"It's not bad genes. It's not bad environment. It's a bad interaction between genes and the environment," said Dr. David Hafler, a professor of immunobiology at Yale University in New Haven, Connecticut, and senior author of one of the three papers.

High salt intake is already a known culprit in increasing the risk of heart disease and hypertension. The new study now implicates high-salt diets in increasing rates of autoimmune disease. "It can't be just salt. We know vitamin D probably plays a small component. We know smoking is a risk factor. This now suggests that salt is also a risk factor," Hafler said.

"How much? We don't know," he added.

Hafler became interested in studying the link between salt and autoimmunity through studies of the gut microbiome - a census of gut microbes and cell function of 100 healthy individuals.

The team noticed that when people in the study visited fast food restaurants more than once a week, they saw a marked increase in levels of destructive inflammatory cells, which the immune system produces to respond to injury or foreign invaders, but which attack healthy tissues in autoimmune diseases.

He shared these findings with colleagues at Harvard Medical School and the Broad Institute of Harvard and the Massachusetts Institute of Technology and others who were working out what factors induce the activity of a type of autoimmune cell known as a T helper 17 or a Th17 cell.

Th17 cells can promote inflammation that is important for defending against pathogens, but they have also been linked to diseases like multiple sclerosis, psoriasis, rheumatoid arthritis, and ankylosing spondylitis. Treatment options for some of these diseases, such as psoriasis, include manipulating T cell function.

"The question we wanted to pursue was: How does this highly pathogenic, pro-inflammatory T cell develop?" said Vijay Kuchroo of the Harvard-affiliated Brigham and Women's Hospital and a member of the Broad Institute.

"Once we have a more nuanced understanding of the development of the pathogenic Th17 cells, we may be able to pursue ways to regulate them or their function."

Hafler said Kuchroo's team worked on tracing how these immune cells were wired, and what triggered their development. They identified a specific gene known as SGK1 that plays an important role in the cells' development. This gene had not been seen in T cells before, but it has been known to play a role in absorbing salt in the gut and kidneys.

"We put the two together and went after this," Hafler said.

Researchers at Harvard and Yale and colleagues in Germany led by Dominik Mueller looked to see whether a high-salt diet could induce the destructive immune system response that is the hallmark of autoimmunity.

They found that adding salt to the diet of mice induced the production of Th17 cells and that mice genetically engineered to develop a form of MS had more severe disease than mice fed a normal mouse diet.

Hafler says the findings now need to be studied in people. He has already gotten permission to test the effects of lowering the salt intake in the diets of individuals with multiple sclerosis to see if their symptoms improve.

It likely be years before this link is confirmed, but Hafler says for patients already at risk of autoimmune disease, reducing dietary salt may be a good idea.

"If I had MS, I would think very much about not eating processed foods and really cutting down my salt intake," he said.

Red Cross releases free ?tornado app?

The American Red Cross has launched its official Tornado App, putting lifesaving information right in the hands of people who live in, visit or have loved ones in tornado-prone areas.

This free app ? available in English or Spanish?gives iPhone, iPad and Android smart phone and tablet users instant access to local and real-time information, so they know what to do before, during and after a tornado. The app includes a high-pitched siren and ?tornado warning? alert that signals people when a NOAA tornado warning has been issued in their area ? even if the app is closed. An ?all clear!? alert lets users know when a tornado warning has expired or has been cancelled.

?Tornadoes often happen in the overnight hours when people are sleeping,? said Jessica McFadden, Emergency Services program manager, Georgia Three Rivers chapter, which includes Troup County. ?The audible alerts in this app can save lives ? even if users can?t monitor the weather because they are away from radio, TV or in places where weather band radios may not work.?

Other features of the app include:

? Location-based NOAA tornado, severe thunderstorm and flood watch and warning alerts;

? Enhanced weather maps;

? One-touch ?I?m safe? messaging that allows users to broadcast reassurance to family and friends that they are out of harm?s way;

? Simple steps and checklists people can use to create an emergency plan and share it with household members;

? Preloaded content that gives users instant access to critical action steps, even without mobile connectivity;

? Toolkit with flashlight, strobe light and audible alarm;

? Locations of open Red Cross shelters; and

? Badges users can earn through interactive quizzes and share on social networks.

Launched during National Severe Weather Preparedness Week, the Tornado App is the latest in a series of mobile apps created by the Red Cross, the nation?s leader in emergency preparedness. The apps have been used to help save lives during hurricanes, earthquakes and wildfires.

?The Red Cross has made great strides in putting vital information in the hands of people who need it during emergencies. In fact, our apps are now on more than two million mobile devices across the country,? said McFadden.

Mobile activity soared due to Superstorm Sandy:

? More than 400,000 people downloaded the Red Cross Hurricane App;

? Nearly 6 million NOAA weather alerts were sent;

? Preparedness content was the most popular feature of the app followed by alerts and the shelter locator;

? The average time spent using the app increased 300 percent; and

? The app had 15 million page views.

Right after the storm, the Hurricane App was updated with real-time recovery information including Red Cross shelter and feeding sites, FEMA sites, open gas stations and warming centers to help those affected by the storm.

The Tornado App, along with the others, can be found in the Apple App Store and the Google Play Store for Android by searching for American Red Cross or by going to redcross.org/mobileapps. Apps can help prepare people for disasters, but they are not a substitute for training. Mars rover Curiosity's recovery on track

Mar. 5, 2013 ? NASA's Mars rover Curiosity has transitioned from precautionary "safe mode" to active status on the path of recovery from a memory glitch last week. Resumption of full operations is anticipated by next week.

Controllers switched the rover to a redundant onboard computer, the rover's "B-side" computer, on Feb. 28 when the "A-side" computer that the rover had been using demonstrated symptoms of a corrupted memory location. The intentional side swap put the rover, as anticipated, into minimal-activity safe mode.

Curiosity exited safe mode on Saturday and resumed using its high-gain antenna on Sunday.

"We are making good progress in the recovery," said Mars Science Laboratory Project Manager Richard Cook, of NASA's Jet Propulsion Laboratory. "One path of progress is evaluating the A-side with intent to recover it as a backup. Also, we need to go through a series of steps with the B-side, such as informing the computer about the state of the rover -- the position of the arm, the position of the mast, that kind of information."

The cause for the A-side's memory symptoms observed last week remains to be determined.

NASA's Mars Science Laboratory Project is using Curiosity to assess whether areas inside Gale Crater ever offered a habitable environment for microbes. JPL, a division of the California Institute of Technology in Pasadena, manages the project for NASA's Science Mission Directorate in Washington.

Emblaze Mobile's First Else may be no more, but its legacy lives on. During MWC we caught up with the company's ex-CEO, Amir Kupervas, who started a company called UIU in June 2011 -- only a month after his departure and almost a year after the tantalizing First Else got canned. Over at UIU, Kupervas and UX strategist Itay Levin (who also took part in the First Else project) have a more humble ambition: to offer an Android launcher and an accompanying cloud management platform that are simple enough for non-techie users. "In the US, smartphones generate twice as much the amount of calls to the customer centers than the featurephones," said Kupervas. "There's a lot of hustle and a lot of confusion on how to work these guys. People are struggling with them, even existing users."
